Hit by insured driver who is avoiding his insurance company.

    I had a driver pull out and hit me on a rural highway. He pulled over and I got his information. He was insured. I also had a driver pull up behind us who witnessed the whole thing and agreed that the other driver was at fault. I called the next day and made a claim with their insurance. The problem is that the other driver is avoiding his insurance company. They told me that he is not answering their phone calls and that if they could not get a hold of him they would have to "respectivly decline" my claim. What can I do? Please give me some good advice as to what to do. Shouldn't the insurance company still be liable since they insured him.

    Take him to court. If you go to small claims you can do it yourself. If you win and they don't pay up their license can get suspended until they pay up.
